TUGERS has created this Privacy Policy in order to inform the client about our policies and procedures regarding the uses and the disclosure of personal information collected on toucan.es.

 2. Users: Access and/or use of the TUGERS portal gives the condition of USER, who accepts such access and/or use of the General Conditions of Uses listed here. The above conditions apply regardless of the General Terms and Conditions of Contract, where applicable. 

 3.Use of Portal: Tugers.com provides access to information, services, programs or data on the Internet belonging to Tugers or to its lessees to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the information collected in order to access certain services or content: the USER will be responsible for providing true and lawful information. With this registration, the USER can receive a password to which he will be responsible, pledging to make diligent and confidential use of it. The USER engages himself to make appropriate use of the website, and services (such as the blog) that TUGERS offers through the portal and by example but not limited to, no to use them for (i) illegal activities, illegal or contrary to good faith activities and public order; (ii) publish content or propaganda of racist, xenophobic, pornographic, illegal, apology of terrorism or against human rights; (iii) cause any damage in Tugers’ hardware and software, its suppliers or third parties, introducing or spreading computer viruses or any hardware or software that are capable of causing such damage as is described above; (iv) try to access, use the email account of other users and modify or manipulate their messages.TUGERS reserves the right to remove any comment and contribution that violate the respect for the dignity of the person, whether they are discriminatory, xenophobic, racist, pornographic, threatening youth or children, order or public safety or in their opinion, are no suitable for publication. Tugers will not be held responsible under any circumstances for the opinions expressed by users through forums, chat rooms or other social medias.

 4.Data Protection: TUGERS meets the guidelines of the Law 15/1999 of December 13th of the Protection of Personal Data, the Royal Decree 1720/2007 of December 21st, approving the regulations implementing the Organic Law and other legislation in force at all times, and ensures proper use and secure processing of personal data. To this end, along with every form of data collection of personal data, in the services that the USER can request to Tugers, it will inform the USER of the existence and acceptance of the conditions of the data processing in each case, informing the responsibility of the file created, the address of the possibility to exercise their rights of access, rectifications, cancellations or oppositions, the purpose of processing and data communications to third parties where applicable. Also, Tugers informs that it complies with the Law 34/2002 of July 11th, of the Services Information Society and Electronic Commerce and will request for consent for the use of his electronic mail address for commercial purposes at any time.

 5.Intellectual and Industrial Property: Tugers is the owner or delegate owner of intellectual property rights as well as the elements contained in it (not limited to, images, sounds, audio, videos, software or texts, trademarks or logos, colours and combinations, structure and design, selection of materials, computer programs necessary for its operation, access and use, etc.), owned by either Tugers or its licensors. All rights reserved. In pursuance of the provision in Article 8 and 32.1, second paragraph, of the Copyright Act it is expressly prohibited to reproduce, distribute and publicise, including any means of making available all or part of the content of this website for commercial purposes, in any form or by any technical means, without the authorization of Tugers. The user undertakes to respect the rights of Tugers’ Intellectual Property ownership. The user can view the portal elements, print, copy and store them on the hard drive of their computer or any other hardware provided, at any time, only and exclusively, for its personal and private use. The user must not remove, alter, evade or manipulate any protection device or security system that was installed on Tugers’ pages.

6. Exclusion of Guarantees and Responsibilities: Tugers will not be under any circumstances for damages of any kind which may cause, but not limited to errors or omissions in the content, lack of availability of the portal or transmission of viruses or malicious or harmful programs in the content, despite having taken all the necessary technological measures to prevent it.

7. Modifications: Tugers reserves the right to make unannounced changes it considers appropriate in its website. It may change, delete or add content and services provided through the web, the same way those are presented or located in the portal. 

8.Links: In the event that Tugers disposes links or hyperlinks towards other websites, Tugers will not exercise any control over such sites and content. In any case will Tugers assume any responsibility for the contents of any link belonging to another website, nor guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, validity and constitutionality of any material or information contained in any such links or other Internet sites. Also, the inclusion of these external connections will not imply any association, merger or partnership with the entities connected. 

9.Right of Exclusion: Tugers reserves the right to deny or withdraw access to the portal and/or services offered without notice, on its own or a third party, to those users who violate these Terms of Use.

11.Modification of these Conditions and Duration: Tugers may change at any time the conditions specified here, duly publicized herein. The validity of these conditions will be according to their exposure and are valid until they are modified by other duly published conditions. 

12. Law and Jurisdiction: The relationship between Tugers and the User shall be governed by the Spanish legislation and any dispute shall be submitted to the Courts of the city of Madrid.

The information you provide is stored in Tugers and is used by us and our partners. All our activities are based on strict ethical principles and we are committed to protecting the privacy of all visitors on our website.
